I can’t say that I didn’t see this one coming. Apple keeps naming products very simple names like Phone, and Cloud simply with an i in front of them. With that kind of naming convention they are bound to run into some sort of trademark or copyright infringement.
Well, the company iCloud Communications is now suing Apple for the use of the iCloud name which they have the rights to. The fact that Apple has already used the name and announced the service, a search for iCloud won’t even display any results for iCloud Communications but that of Apple’s new iCloud service. This is specifically stated in the lawsuit which is shown below:
The goods and services with which Apple intends to use the “iCloud” mark are identical to or closely related to the goods and services that have been offered by iCloud Communications under the iCloud Marks since its formation in 2005. However, due to the worldwide media coverage given to and generated by Apple’s announcement of its “iCloud” services and the ensuing saturation advertising campaign pursued by Apple, the media and the general public have quickly come to associate the mark “iCloud” with Apple, rather than iCloud Communications.
I can honestly say that I would be very angry too if my company’s name was stolen and reused and all of my business taken from me after years of hard work. The company iCloud Communications has been around since 2005 and I also find it hard to believe that Apple did not know that when choosing the name iCloud for their services. I have a feeling that more truth may be revealed in this case in the near future. For now, read the entire suit below for more details.
